Summary

Tempo Trace plays a steady metronome beat and measures how closely finger taps or hand claps line up with it, in a feedback-free Testing mode or a Training mode that shows Early / On beat / Late after each response. It can be used by healthcare professionals with their clients, or by individuals on their own. In Clap mode the app listens through the device microphone to detect the moment of each clap — the sound is analysed on the device as it arrives and is never recorded, saved, uploaded, or shared. Results exist only in the device's memory while they are on screen and are discarded when you leave the results screen. There is no account, no sign-up, no cloud sync, no network connection, and no analytics or advertising SDK of any kind. We never receive any information about you or your results.

1. Who we are

CHM Solutions Pty Ltd ("we", "us", "our") develops and publishes the Tempo Trace iOS application. For privacy enquiries, visit our Contact Us page.

2. Who this policy applies to

This policy applies to everyone who uses the Tempo Trace app ("you"). The app can be used in two ways:

  • Personal use — an individual downloads the app and uses it themselves, for example to practise keeping time with a beat. In this case you are both the person operating the app and the person doing the task.
  • Professional use — a healthcare professional or clinical researcher ("practitioner") sets up the app and administers the task to another person ("participant"), for example during an appointment.

Wherever this policy refers to "you", it means whoever is using the app. Where something applies only to professional use, we say so. Practitioners are responsible for ensuring their own use of the app complies with all applicable laws and professional obligations in their jurisdiction, including any participant consent requirements.

3. What data the app processes

3.1 Microphone audio (Clap mode only)

When Clap mode is selected, the app uses the device microphone to detect the moment each clap occurs. This happens during a short room check (which measures background noise and listens for two test claps) and during the Clap session itself.

  • Sound is analysed on the device as it arrives, only to find the timing of each clap and to estimate the level of background noise.
  • Audio is never recorded or saved — no audio file is created, and each fraction of a second of sound is discarded as soon as it has been analysed.
  • Audio is never uploaded — no sound is sent to us, to Apple, or to any third party.
  • The microphone is used only while a room check or Clap session is running. Finger Tap mode does not use the microphone at all, and Clap mode is available on iPhone only.

Because the microphone is open during a Clap session, it may pick up other sounds in the room, such as speech. These sounds are treated in exactly the same way: analysed for their loudness and timing only, never recorded, saved, or understood as speech, and discarded immediately.

3.2 Responses and timing

For each session the app records, in memory, the exact time of each scheduled beat and of each response (the moment a finger touches the screen, or the detected onset of a clap), whether each response was matched to a beat, missed or extra, and — for claps — a detection confidence level. For taps, the app records only when the touch occurred, not where on the screen it was. This data is used only to calculate the on-screen results: valid responses, mean signed offset, average absolute offset, timing variability, the percentage within the on-beat window, and missed and extra counts.

3.3 Session details

To help interpret a result, each result also includes technical context: the session settings (response method, mode, tempo, duration and on-beat window), the app version, device model, iOS version, the audio output and input in use (for example "Built-in speaker"), audio timing characteristics, the volume level, and — for Clap — a background-noise summary. This is shown under Session details on the results screen and is held in memory with the result. It does not identify you or anyone else.

3.4 Results are not saved

Results are held only in the device's memory while the results screen is open. They are discarded when you choose Back to setup or Repeat with same settings, or when the app is closed. The app does not keep a history of sessions and does not save results to the device, to iCloud, or anywhere else. If you want to keep a result, you will need to note it down yourself before leaving the results screen.

3.5 Settings stored on the device

The app stores two small pieces of information in its local settings on the device:

  • that the opening disclaimer has been acknowledged (so it isn't shown on every launch), and
  • any tempo, duration or on-beat window you have chosen to Save as default.

These contain no information about you or anyone else and are removed when the app is uninstalled.

3.6 Data we do not collect

The app does not collect, transmit, or store:

  • Names, email addresses, accounts, identifiers, dates of birth, or demographic information
  • Audio recordings of any kind
  • Test results, beyond the results screen currently open
  • Health records or information from Apple Health
  • Contacts, location, camera, photos, or any device data unrelated to the task itself
  • Any usage analytics — the app has no analytics, advertising, or third-party tracking SDK, and makes no network connections

We do not sell, rent or share personal information, because we never receive any from the app. The app contains no advertising and does not track you across other apps or websites.

4. Permissions requested

  • Microphone — required only for Clap mode. It is requested when Clap is first chosen, after an on-screen explanation, never at app launch. Usage description shown to the user: "Tempo Trace uses the microphone to detect when you clap. Sound is analysed on this device and is not recorded or sent anywhere."

The permission can be declined, or later turned off at any time in the iOS Settings app; declining it means only Finger Tap mode is available.

The app also declares, in its Apple privacy manifest, that it reads its own local settings (for the saved defaults above) and the device's system clock (to time beats and responses precisely). Neither is used to track you or the device.

5. Regulatory context

5.1 HIPAA (United States)

CHM Solutions Pty Ltd is not a covered entity or business associate in respect of the Tempo Trace app. The app does not receive, create, maintain, or transmit electronic protected health information (ePHI) on behalf of any covered entity or business associate: clap detection, matching and scoring all happen locally on the device, results are held only in memory, and nothing is sent to us. When an individual uses the app for themselves, HIPAA does not apply to that personal use. When a practitioner uses the app, no Business Associate Agreement with CHM Solutions Pty Ltd is required, because the app never transmits or stores participant data off-device; practitioners remain responsible for how they record and store results outside the app, under their own HIPAA obligations.

5.2 Australian Privacy Act 1988

CHM Solutions Pty Ltd is an Australian company and operates in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). Timing results may, briefly and while on screen, be health-related information, but they are created and held only in memory on your device and are never collected or received by CHM Solutions Pty Ltd — so most APPs are not engaged in ordinary use of the app by us. Practitioners remain responsible for any results they choose to record outside the app, in line with their own APP obligations. Any personal information you provide to us directly (e.g. via support requests) will be handled in accordance with the APPs and used only to respond to your enquiry.

5.3 GDPR (European Economic Area and United Kingdom)

If you are located in the EEA or UK, the following applies:

  • Controller: CHM Solutions Pty Ltd acts as data controller only in respect of any personal data you send to us directly (e.g. support messages). We do not act as controller or processor for any audio or results data within the app — audio is never recorded and nothing is transmitted to us.
  • Processors: The app uses no third-party analytics or data processors of any kind.
  • Legal basis: Legitimate interests or contract performance for support communications only.
  • Your rights: You have the right to access, rectify, erase, restrict, or port any personal data we hold about you, and to object to processing. Because the app sends us nothing, the only personal data we could hold about you is anything you have sent us directly. Visit our Contact Us page to make a request.
  • Health data: Timing results may briefly constitute special category (health-related) data while they are shown on the device. Because this data is never transmitted to or held by CHM Solutions Pty Ltd, we do not process it as controller or processor under GDPR. When an individual uses the app for themselves, this is purely personal use. When a practitioner administers the task, the practitioner is responsible for any record they make of the results.
  • International transfers: No audio or results data leaves your device, so no international transfer occurs in respect of that data. Where we receive personal data from EEA contacts directly (e.g. support enquiries), we rely on standard contractual clauses or consent as our transfer mechanism.

6. Data retention and deletion

Microphone audio is discarded as soon as it has been analysed — fractions of a second after it is captured — and is never written to storage. Results are discarded when you leave the results screen or the app is closed. The only data the app keeps between uses is the disclaimer acknowledgement and any saved setting defaults, which contain no personal information and are removed when the app is uninstalled. Because nothing is transmitted off the device, there is no server-side copy to delete, and there is no account to close. Any personal data sent to us via support is retained only as long as necessary to resolve the enquiry, and no longer than 3 years.

7. Security

Clap detection, response matching and scoring all take place entirely on your device, and no audio or results data is transmitted over any network at any point. Because results are not saved, there is no stored session history on the device to protect. Responsibility for securing the device — passcode or biometric lock, timely iOS updates, physical security — lies with the device owner. Practitioners should also follow their organisation's device management policies.

8. Health and clinical framing

Tempo Trace is not a certified medical device. The app is for information purposes only. It does not constitute a doctor–patient relationship and does not replace an assessment by a registered healthcare professional; always seek professional advice. It does not provide a diagnosis, an impairment classification, a treatment recommendation, or any percentile or normative comparison, and it does not produce a composite score. If you are using the app for yourself and are concerned about your coordination, movement or timing, please speak with a registered healthcare professional.

Training results are shown with a notice that they are not equivalent to a Testing session, and finger-tap and clap results are measured differently and should not be compared with each other. Timing measurements depend on the device and audio output in use — wireless audio such as Bluetooth or AirPlay is blocked because its delay varies — and clap detection can be affected by background noise, room echo, clap technique and how the phone is placed; the app marks uncertain claps as low confidence and excludes them from timing measures.

9. Children

Tempo Trace is not directed at children, and we do not knowingly collect personal information from anyone, including children. The app has no account or sign-up and collects no personal information from any user or participant. If a child uses the app — for example during an appointment with a practitioner — this should be with the involvement of a parent, guardian or practitioner.

10. Future changes

We may in future add optional features, such as exporting results to a companion platform, for users who choose to opt in. These are not implemented in the current version of the app. If and when they ship, we will update this policy first.

11. Changes to this policy

We may update this policy to reflect changes in the app or applicable law. Material changes will be noted on this page with a revised effective date. We encourage you to review this policy periodically.
